Information Collected Through AI-Powered Assessment Services

When you participate in an AI-powered interview or assessment through our Services, we collect and process the following additional information:

  • Audio recordings of your spoken responses during the assessment session
  • Text transcripts generated from your audio recordings
  • AI-generated evaluation scores based on the text content of your responses
  • Session metadata, including timestamps and session duration

Our AI assessment system evaluates only the substantive content of your spoken words — your demonstrated skills, knowledge, and qualifications relevant to the position. The system does not analyze your vocal tone, pitch, inflection, cadence, accent, or any other speech characteristics. It does not perform emotion detection, sentiment analysis based on voice characteristics, or any form of biometric analysis. It does not evaluate your physical appearance, facial expressions, or any visual information.

Audio recordings are used solely to generate text transcripts for assessment purposes. Your assessment data is collected and processed only for the purpose of evaluating your candidacy for the specific position for which you are being assessed. We will not repurpose your assessment data for model training, analytics, profiling, or any other purpose without your separate, explicit consent.

Sensitive Information

When you use our AI-powered assessment services, we collect audio recordings of your voice responses. Depending on your jurisdiction, voice recordings may be classified as sensitive or biometric information. We process this data solely to generate text transcripts for evaluation purposes. We do not extract voiceprints, perform speaker identification, or use voice data for any purpose other than transcription and candidate assessment. We do not analyze facial expressions, vocal tone, pitch, inflection, or other biometric characteristics.

2. How Do We Use Your Information

We use collected information for purposes including:

We may process your information, including audio recordings and text transcripts, to conduct AI-assisted candidate assessments on behalf of our employer customers. Assessment data is processed solely to evaluate your candidacy and provide results to the hiring organization. AI-generated scores serve as decision-support tools only; a human recruiter or hiring manager reviews all results before any hiring decision is made.

3. Legal Bases for Processing (GDPR)

For users in the EU and other jurisdictions with similar laws, we process your information based on:

  • Consent: Where you have provided explicit permission
  • Contract: To provide Services you have requested
  • Legal Obligation: To comply with applicable laws
  • Legitimate Interests: To improve Services, prevent fraud, or protect security
  • Vital Interests: To protect your health, safety, or life

4. Who Do We Share Your Information With

We may share your information with:

We do not sell your personal information to third parties for their independent marketing purposes.

5. How Long Do We Keep Your Information

No purpose in this notice will require us keeping your personal information for longer than forty-eight (48) months past the termination of the user's account. Specific retention periods by data type:

  • Identifiers, personal records, protected characteristics, professional information, and inferences: Up to 48 months after account closure.
  • Biometric information and audio/electronic information (assessment recordings, transcripts, and scores): Retained for the duration specified in the applicable employer agreement, not to exceed 48 months after assessment completion, subject to earlier deletion upon your request.

For AI-powered assessment data specifically, we retain data as required by applicable law (including jurisdictions that mandate minimum retention of automated decision records) and in accordance with our agreements with employer customers. You may request deletion of your assessment data at any time, and we will process deletion requests within thirty (30) days, subject to any legally mandated retention requirements.

6. Security of Your Information

We implement administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, alteration, or destruction. These measures include:

  • Encryption of data in transit and at rest
  • Secure authentication mechanisms
  • Regular security audits and vulnerability assessments
  • Employee access controls and confidentiality agreements
  • Incident response procedures

However, no security system is completely impenetrable. We cannot guarantee absolute security of your information.

7. Information About Minors

Our Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors under 18. Our AI-powered assessment services are available only to individuals who are at least 18 years of age. We do not conduct AI-assisted interviews or assessments on any individual under the age of 18. If we learn that an individual under 18 has participated in an AI-powered assessment, we will promptly delete all associated data, including audio recordings, transcripts, and evaluation scores.

You may have the following rights regarding your personal information, depending on your location:

8A. Your Rights Regarding AI-Powered Assessments

If you participate in an AI-powered assessment through our Services, you have the following rights regardless of your geographic location. Certain jurisdictions may provide additional protections, which are reflected in the scope of these rights.

Before the assessment:

  • Right to Notice: You will receive written notification that an AI system will be used to evaluate your responses, including an explanation of how the AI works, what it evaluates, and how the results will be used, before the assessment begins.
  • Right to Consent: You must provide explicit consent (such as checking a consent box) before the AI-powered assessment proceeds. You are not required to consent.
  • Right to Decline: You may decline to participate in the AI-powered assessment and request an alternative evaluation method from the hiring organization. Declining will not disadvantage your candidacy or result in any penalty.

During and after the assessment:

  • Right to Human Review: AI-generated assessment scores are decision-support tools only. You have the right to request that a qualified human reviewer evaluate your candidacy independently of the AI-generated results. All hiring decisions are made by human recruiters or hiring managers, not by the AI system.
  • Right to Explanation: You may request a plain-language explanation of how the AI system evaluated your responses, what factors influenced your score, and what type of AI system was used.
  • Right to Access: You may request a copy of your assessment data, including audio recordings, transcripts, and AI-generated scores.
  • Right to Correction: You may request correction of inaccurate personal data associated with your assessment.
  • Right to Deletion: You may request deletion of your assessment data, including audio recordings, transcripts, and evaluation scores. We will process deletion requests within thirty (30) days of receipt, subject to any legally mandated retention requirements.
  • Right to Data Portability: You may request a copy of your assessment data in a structured, commonly used, machine-readable format.
  • Right to Opt Out of Automated Profiling: You may opt out of having your assessment data used for automated profiling, predictive analytics, or any purpose beyond evaluation of your candidacy for the specific position for which you were assessed.

Employer responsibilities: The hiring organization that invited you to the assessment is responsible for delivering required notices within the timeframes required by applicable law, offering alternative assessment paths, conducting or facilitating any required bias audits, and ensuring that human reviewers exercise independent judgment when considering AI-generated results. We provide documentation and support to assist employers in meeting these obligations.

9. Do Not Track Signals

Some web browsers include a "Do Not Track" feature. Our Services do not currently respond to Do Not Track signals. We encourage you to use other privacy settings and tools available in your browser.

Automated Decision-Making Disclosure

Our Services may use automated decision-making and profiling in connection with AI-powered assessments. These automated decisions are designed to support hiring organizations in candidate evaluation. However, we ensure that:

  • Automated assessment scores serve as decision-support tools only
  • All hiring decisions are subject to human review by a recruiter or hiring manager before implementation
  • You have the right to request human review and explanation of automated assessment decisions
  • You have the right to object to automated processing and request alternative assessment methods

10. Additional Rights Under Applicable Law

We are committed to complying with all applicable federal, state, and local privacy laws and regulations governing the use of artificial intelligence in employment decisions and the collection and processing of personal data. The rights described in Sections 8, 8A, and 9 of this Privacy Policy are designed to meet or exceed the requirements of all jurisdictions in which we currently operate, including but not limited to those with laws specifically addressing AI in hiring, biometric data, consumer privacy, and automated decision-making.

If applicable law in your jurisdiction provides rights not listed in this Privacy Policy, we will honor those rights upon request. This includes, without limitation, any rights to opt out of automated profiling, request bias audit summaries, obtain impact assessment disclosures, or receive advance notice of AI-assisted evaluation in the hiring process.

We have not sold personal data to third parties for business or commercial purposes, and we do not intend to do so. We have not knowingly sold or shared the personal information of individuals under 18 years of age.
